FRUXINFO PRIVATE LIMITED – REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy outlines how refunds, cancellations, and partial settlements work when you engage Fruxinfo Private Limited for IT services, development, SaaS, or digital marketing.

Our goal is to be transparent, fair, and professional — while ensuring business continuity and clear expectations for both sides.

1. General Refund Policy

Once work has begun, all payments are generally non-refundable.
This is because planning, resource allocation, project management, and development costs are incurred immediately.

However, we do offer refunds in specific, genuine scenarios described below.

2. Situations Where Refunds ARE Eligible

2.1 If Fruxinfo Fails to Start Work

If we do not begin work within 30 days of your advance payment — and the delay is not caused by you — you may request a refund.

Refund Amount:

  • 90% of the advance (a 10% admin fee is deducted)

2.2 If Fruxinfo Abandons the Project

If we stop or abandon the project without valid cause (and it's not due to client breach), the refund will be:

  • A pro-rated amount for incomplete milestones
  • Completed deliverables are still payable

3. Situations Where Refunds Are NOT Provided

Refunds will not be issued in the following cases:

3.1 Client Cancels After Work Has Started

Once work begins, the advance and milestone payments are non-refundable.

3.2 Change of Mind / Business Direction Changes

If you change your idea, business model, or strategy after the project starts, it does not qualify for a refund.

3.3 Inability to Provide Requirements or Inputs

If timelines slip because you cannot provide content, credentials, approvals, or communication - refunds are not applicable.

3.4 Delay Caused by Client

Client-side delays (content, revisions, meetings, assets, approvals) do not qualify for a refund.

3.5 Third-Party Services / Platform Issues

Refunds are not provided for failures of or changes in:

  • Hosting
  • API services
  • Payment gateways
  • SMS/email gateways
  • Play Store / App Store rejections
  • Server downtime

3.6 Marketing & SEO Performance

Marketing outcomes depend on algorithms, audience behavior, competition, and market fluctuations.

Hence, we cannot refund for:

  • No leads
  • No traffic
  • No conversions
  • Low performance

3.7 Force Majeure Events

No refunds for delays or issues caused by events outside anyone's control (pandemics, disasters, war, etc.).

3.8 Approved Work or Approved Milestones

If a milestone is approved and signed off by the client, the payment is final and non-refundable.

3.9 Unused Retainers or Hours

Pre-purchased support hours or retainers that remain unused cannot be refunded.

4. Partial Completion Settlement (Fair Settlement)

If a project ends by mutual agreement, the following applies:

  • You pay for all completed milestones
  • You pay proportionally for partially completed work
  • The non-refundable advance is adjusted against the balance

This avoids unnecessary disputes and ensures both sides receive fair value for work completed.

5. Refund Processing Timeline

If a refund is approved:

  • It will be processed within 30 business days
  • Refunded to the original payment method
  • Transaction fees (gateway, bank, forex) will be deducted

6. Cancellation Policy

6.1 Cancellation by Client

You may cancel the project with 30 days' written notice.

To complete cancellation, you must:

  • Pay for all completed work
  • Pay for partially completed work
  • Pay a 10% termination administration fee on remaining contract value

6.2 Cancellation by Fruxinfo

We may cancel immediately for:

  • Non-payment beyond 21 days
  • Repeated breach of terms
  • Illegal use of our services
  • Abusive or harassing behavior

In such cases, refunds are not applicable.

7. What Happens After Cancellation

Once a cancellation is processed:

  • All outstanding payments become due immediately
  • Work-in-progress is delivered only if paid for
  • Access to servers, code, or admin panels may be revoked until dues are cleared
  • After full payment, project files, documentation, and credentials are handed over
